Freedom of Information (FOI) Publication Scheme

Welcome to the Marple Cottage Surgery & Guywood Practice Publication Scheme. This is a guide to the practice Publication Scheme as required by the Freedom of Information Act 2000.

Under the Freedom of Information Act every public authority has a duty to specify what information they publish (in terms of information ‘classes’), how the information is made available, and whether it is available free of charge or upon payment.

It does not cover personal information such a patients records which are covered by the Data Protection Act

Practice FOI Publication Scheme

A publication scheme requires an authority to make information available to the public as part of its normal business activities.  The scheme lists information under seven broad classes

  • who we are and what we do
  • what we spend and how we spend it
  • what our priorities are and how we are doing it
  • how we make decisions
  • our policies and procedures
  • lists and registers
  • the services we offer

 

 

How should requests be made?

Requests must:

  • be made in writing (this can be electronically e.g. email/fax)
  • state the name of the applicant and an address for correspondence
  • describe the information requested.

 

What cannot be requested?

Personal data about staff and patients covered under Data Protection Act.

Practice FOI Publication Scheme Contents

Part I – Introduction

This Publication Scheme is a complete guide to the information routinely made available to the public by Marple Cottage Surgery & Guywood Practice . It is a description of the information about our General Practitioners and Practice which we make publicly available. It will be reviewed at regular intervals, and we will monitor its effectiveness.

  1. How much does it cost?

With the current changes in legislation, we will no longer be able to charge for copies of your medical records subject to the request not being unreasonable. However, we are still able to charge for certain medical reports. All requests in writing to our Data Controller team and they will advise you accordingly.

Leaflets and brochures – free of charge for leaflets or booklets on, for example, services we offer to the public. A charge will be made to cover postage costs. A list of available publications is given in Class 4.

  1. How is the information made available?

All information is available on the Practice website.

  1. Your rights to information

The Freedom of Information Act 2000 recognises that members of the public have the right to know how public services are organised and run, how much they cost and how the decisions are made.

From 1 January 2005 it will oblige the General Practice to respond to requests about information that it holds and is recorded in any format and it will create a right of access to that information.

These rights are subject to some exemptions which have to be taken into consideration before deciding what information it can release.

New environmental information regulations may be introduced as early as 2003. These will enable similar access to environmental information as under the Freedom of Information Act 2000.

Part II – Classes of Information

Our commitment to publish information excludes any information which can be legitimately withheld under the exemptions set out in the NHS Openness Code or Freedom of Information Act 2000.

Where individual Classes are subject to exemptions, the main reasons include the protection of commercial interests and personal information under the Data Protection Act 1018.

This applies to all Classes within the Publication Scheme. The information on this Scheme is grouped into the following broad categories.

Class 2 – What we spend and how we spend it

We are funded to provide primary healthcare services. This includes (please note the list is not exhaustive):

  • Access to a doctor or nurse for undiagnosed conditions
  • Ongoing monitoring of existing (chronic) conditions

English is the only language spoken by staff at the practice. If your first language is not English, then we can arrange for an interpreter to be present. This can take up to 4 days to arrange.

The information made available as part of GPs’ contractual obligation to publish their net income relating to NHS/HSC contracts.

We receive money from NHS Manchester according to our contract (as per Class 1 above) in exchange for general medical services provided for patients.
